In the death records, of Torphichen Church, there is an entry on 14 Feb. 1819, "2/0 by cash from James Aitken for the children's mortcloth used to his deceased child Janet."

In Mar 1821 James paid 6/8 for the use of the' best mortcloth' to bury his father.
The hiring out of the 'mortcloth' was a means of the Church Minister making some money. The church usually owned three standards of 'mortcloth', which was used to cover a coffin.
Hiring the 'best mortcloth' for his father's funeral would indicate that James had become a man of some standing.

The monumental inscription reads;
"James Aitken feuar here, wife Ann Arthur died 22 June 1839 aged 51, daughter Janet died 9 February 1819 aged 5, son James 25 June 1841 aged 25."

James paid for the "best mortcloth" at the funeral of his brother Walter in Torphichen in 1822.

On 17 Jul.1814 Peter paid for the banns to be read. "Proclamation of Peter Aitken, in this parish (Torphichen) and Janet Pearson, in Linlithgow, twice in one day".

In 1832 he paid 6/8 for the use of the "best mortcloth used to the deceased Marion Liddell", his mother-in-law.

On the 1st Dec 1837, he was absolved by the Kirk Session at Torphichen, of the sin of drunkenness, using profane language and riotous behaviour but not before having held out for quite a while against the Session.
The following comes from the research of Graham Marshall, with great thanks.
" Peter was charged with the offences when he went to the minister, in Feb 1833, to arrange to have his son Robert baptised. The minister took the opportunity to report him to the Session ' in consequence of certain complaints as to the repeated instances of drunkenness as of late'.
Peter Aitken initially refused to play their games which led to the Session appointing a committee comprising the Minister, the Session Clerk and four Elders to sort him out.
Thus it was that Peter appeared before this Church Court in Torphichen on 25th March 1833 charged with one specific instance of his alleged offences and that on the night of New Years Day he had been in widow Arthur's house 'in a state of intoxication and of then or there having uttered profane oaths and of having conducted himself both in the said house and about the door in a riotous manner.'
He admitted that he had been in the house but denied that he had been intoxicated or uttered profane oaths or behaved in a riotous manner. The Session then called witnesses to prove their case.
First came widow Arthur (Agnes Walker widow of the late Thomas Arthur) who remembered Peter Aitken coming to her house about ten or eleven o'clock and that while he had been drinking he was in control of himself. It appears he sent her for a bottle of whisky and that she had brought him half a bottle and was sent for and found another, there is no mention of where she found them.
It seems the company were willing to share Peter's first bottle of whisky but not so the second, referred to in the Session Minutes as 'spirits in a bottle'. He appararntly tried to persuade Norman McQueen to take a drink but there was something about it that persuaded Norman to throw it on the back of the fire which displeased Peter Aitken who threatened to ' pit him up in the reek'.
There seems to have been a scuffle after that but there was conflicting evidence from the widow Arthur and others as to exactly what happened. John Brodie and Norman McQueen seemed to be involved asn so it seems was Peter. There seems to have been an attempt to take the disagreement outside which resulted in Norman being pulled into the house and Peter, being outside, hammering on the door to be let back in. John Brodie clearly had remained inside since he, it was claimed, had gone to the door and asked if they wanted him. It sounds as if William Aitken was also outside although the evidence hardly mentions him. Peter apparently answered 'No it was old Nany and young Nanny and Mary and that them to put them in the dam.'
The second witness, Paul McFail refused to take the oath so the proceedings were postponed until the following day to hear more witnesses; Agnes Arthur the widow's daughter, John Marshall and Margaret, his daughter.
Agnes seemed clearer than her mother about who was in their house on New Year's night. She told how Mary Gunn, Norman McQueen one of their lodgers, John Brodie another lodger and her mother were there when Peter Aitken came in with William Aitken (possibly his brother) but supported her mother's view that he was not drunk. She was also clearer about who left, listing Peter Aitken, William Aitken, Paul McFail and John Brodie. She, her mother and Mary Gunn then went to bed, however she later said she had been in bed all of the time and couldn't see all that happened. It seems that John Marshall came in towards the end of the incident and had the poker taken to him by Agnes who had risen from her bed to clear the house. His testimony added a touch of farce when he claimed to remember meeting Peter Aitken and going with him to James Aitken's (probably another brother) house then on to Philip Gunn's house but that he could not remember being in widow Arthur's house. His daughter Maggie cleared that one up when she told how she had collected her father from there and took him home.
There is something ironic in the choice of date to hear the evidence for the defence - April first.
Peter went first and he admitted using intemperate language but not fighting or being drunk. He called Philip Gunn who described Peter Aitken as 'except for himself, the soberest man in the company in his house on the night of the 1st of January'.
The evidence seemed to have little effect on the Session Committee who referred it to the Presbytery who met two days later at Linlithgow where Peter argued that the evidence given for and against him was contradictory. But did acknowledge that he 'had in face of much provocation spoken one unguarded word for which he was sorry and resolved to be on his guard'. But that was not enough for the Presbyters who 'resolved without a vote to appoint a committee of three to examine the extract minutes of the Kirk Session of Torphichen and report to next meeting of Presbytery what facts appeared to them to be substantiated by the evidence.'
The committee reported back in three weeks with a neat summary of what they saw as the evidence. They were 'clearly of the opinion that the evidence proves that Peter Aitken had been drinking freely in the house of Philip Gunn, that he came with others to the house of Widow Arthur and sent for whisky. But it does not seem proved that Peter Aitken was very much intoxicated; that it seems true that Peter Aitken did then use profane language and behaved in a riotous manner in the Widow Arthur's house and after outside of her door demanding admittance and that the witnesses brought by Peter Aitken do not in any respect rebut the evidence on the part of the prosecution.'
The Presbytery agreed with the findings and referred it back to the Session for action who in their turn referred it to the Minister, His success in dealing with Peter Aitken was complete. He took only another two an a half years to persuade Peter to apologise to session. Whether Robert and his sister " (Roobert and Catherin children of Peter who were born in this time)" were then baptised is not recorded but normal service was resumed with the baptism of the next child, Mary Ann in 1938."

James, his wife, and three children sailed to NZ, on board the "Simlah", They departed from London and travelled via Wellington, on the north island of NZ, then on to Dunedin, Otago, in the south island. They travelled steerage class and arrived at Port Chalmers, (Dunedin), 23 November 1851.
Taking up land at East Taieri they called it Woodside. This was just off Bush Road, on the Riccarton Road, towards Silverstream

When the McNab Run was available for settlement in 1875, James and his two sons Peter and Thomas took up "Hawthornden".

William, Jessie, Jane and William junior departed from Leith, for NZ, on board the "Strathallen", in 1857.
The ship left Leith on the 4 Oct 1857 arriving at Port Chalmers, Otago, 8 Jan 1858 after a voyage of 96 days. Even after that long journey they still had to wait four days before they could get ashore.
By the time the family arrived in NZ there had been an addition to the family, Johan Todd Strathallen Aitken. The boy was named after the master of the ship and the ship itself.
This is rather surprising given the report of the captain's conduct. An extract from the "Otago Witness" of Saturday January 16th, 1858, reads;
"We have to welcome the immigrants by the Strathallen which arrived in this port on Friday last, bringing 289 passengers.
She left Leith on Sunday 4th of October, and had a fine passage of 79 days from land to land, and landed her passengers on the 100th day from leaving the Leith docks. The voyage was, we understand, a very agreeable one. We have to regret the death of one adult and several children, the latter being chiefly infants born on the voyage. The ship was plentifully and well found, and the passengers were much indebted to Mr Greene, the chief officer, to whose hands the management of the ship chiefly devolved for his considerate attention. We regret to hear that the conduct of the Captain was not such as could be desired, but any definicies (sic) on his part were fully made up by the conduct of his subordinates. It is satisfactory to know that the conduct of Mr Greene, the chief officer, has met with its due reward, that gentleman having conceded to the command of the vessel, the captain having resigned his charge."
In an extract from "NZ Shipwrecks and Tragedies";
"When the Strathallen arrived in Otago in 1858, after a voyage on which her master, Captain John Todd, spent most of his time rip-roaring drunk, the whole crew struck and was imprisoned for its common sense."
On the same ship travelled Thomas Aitken, William's cousin
William lived in Mosgiel and later Outram, Otago, where he was involved in the building trade. In 1879 he built a school at Taieri Ferry on the Taieri Plain. The school was established on the condition that the settler's children and the local Maori children are allowed to be educated together. This was the only school on the plain where this was permitted. It remained this way until its closure in 1925.

Before marrying James, Ann had a child out of wedlock, in 1848 and was taken before the Church Session where she confessed "that she had brought forth a male child in fornication the father of whom is Thomas Whyte junior, baker residing in Bathgate and that he has acknowledged the paternity. The session having been previously acquainted with these facts took her upon discipline she was accordingly solemnly exhorted and rebuked and absolved and restored to Church privileges".

Despite this Ann does not seem to have learnt her lesson.
James and Ann's first child, Peter was born 4 months after they married. On 9 May 1852 Ann again had to front the Church Session at the manse, this time along with her husband James.
Present was the Rev. William Branks, Moderator and Messres Calder and Sleay, Elders.
"James and Ann Dale confessing that they had been guilty of ante-niutial fornication. They were solemnly rebuked and absolved of the scandal of said sin and Ann Dale was restored to the privileges of the Church with prayer. (Signed) William Branks, Moderator."

What is strange about this that Ann had her privileges restored but not James.

James was the informant on the death of his mother-in-law, Margaret Kay, in 1870.

Second of Apr 1871 saw him as farm manager of Torphichen Mains, a 40 acre farm containing a house and byre. The farm was owned by the heirs of Margaret Dale, his wfe's mother

Graham Marshall reports "James purchased a dwelling house on the south side of the Close in Torphichen Village on the 26 Feb 1873 from his wife's nephew, William Dale who had moved to Glasgow. The property included a 1/4 part of the Fala Moss and the piece of ground , part of the Loch of Torphichen which by then had been dried out to form a yard on the south and west side of the house. Its location was described as 'bounded on the east by the highway; tenement of Houses and Yeard (sic) thereto belonging on the south part of the easter half of a pece of ground called the Loch of Torphichen betwixt the Mains Yeards on the north, the Loch Yeard on the south and the Beanyard on the west'. It looks likely that this was merely James buying out his wife's relations from their share of his mother-in-law's property."

James was the informant on the death of his duaghter, margaret, in 1877.

Death Notes: James' death was reported by his neighbour, William Taylor McRain of Millburn Cottage suggesting there was no family member available to inform the registrar and certainly his wife and children were dead and his siblings scattered. His sister Marion and family to Bathgate over fifty years before; Jane and brother Robert to New Zealand around the same time; Robert to Edinburgh where he had married sixty years before; Mary Ann and family had moved about but were back in Fauldhouse before she died a few years before James; similarly Peter had died in Armadale only six years before and John in Torphichen a few before that. One have might have expect several nieces and nephews in or fairly near the village but perhaps his neighbour knew him best.

a letter, written by this Robert's father to Robert's brother Thomas, it says; "I am sorry to inform you that on the 25th of January Brother Robert lost his eldest son Peter a fine boy 6 years old of water in the head and about the same time Alexander Little Bobbys second son died suddenly he went to bed in his usual good health and died in less than half an hour." Punctuation is as it was in the letter.
I do not know who this, "Alexander", is, yet. Probably he was this Robert's son. Doubt arises because the letter refers to Brother Robert and then in the same sentence as Little Bobby as if they were two different people.
Robert was variously described as a labourer, telegraph inspector and a mechanical engineer

1858 he emigrated to NZ, on board the Strathallen.
He was one of the earliest carpenters in the Otago district. His workbook covering the period 1864 -1875 shows that he turned his hand to many jobs, mainly farm work. It also recorded that he worked for many people including James Aitken, his future father-in-law.
Prior to 1872 most of Tom's work had been seasonal but now he was almost permanently working at the Mosgiel Woollen Mills and a number of houses in the locality.
In 1874 and 1875 he was engaged on the new railway station and goods shed. In the village there were new opportunities as the town began to develop.
Tom bought land in Bush Road, Mosgiel where he built his family home, at what is now 114 Bush Road.
The Timber for the house was hewn in an area known as Mosgiel Bush in Carlyle Road. The timber was pit sawn and the pits were still visible in the 1930's.
Thomas was a pillar of the community being involved with many good works in and around Mosgiel.
A school committee was elected in 1873. Two of the members were J. Smeaton and T. Aitken. In 1883 there was a big hotel fire. This highlighted the need for a good water supply. Tom served on the Mosgiel Borough Council from 1885 to 1917. Nothing eventuated, about the water supply until 1892 when the council appointed a sub-committee to investigate the best method of obtaining the water.
Tom became the Mayor of Mosgiel in 1900, serving as mayor until 1905-6.
As mayor he chaired patriotic meetings held for the purpose of raising funds to support the cause in the Boer War. Over 100 pounds were raised and within the week the figure had exceeded 250 pounds.
In 1903 he was president of a committee to form the Taieri Pipe Band.
Tom was a member of the Freemason and Druid Lodges, also a member of the Burns Club Choir and the Racing Club.
In July 1906 a public meeting was convened by the Mayor, Thomas Aitken, to form a Fire Brigade.
He died, at his home in Mosgiel, on 22 Oct. 1922.

coming to Australia in 1848, Magnus lived close to Hopetoun House, the ancestral home of the Earl of Hopetoun, Lord Linlithgow. Magnus's father was a tenant of the Earl's estate.
When Magnus first arrived in Melbourne he ran a grocery store until the time he joined the Victorian gold rush. He tried his luck at prospecting at Ballarat and later at Kyneton.

Magnus must have made money from the gold rush either through prospecting or his business skills. He started a brewery in Loddon. Later he went to Gippsland where he helped build the Shire Hall at Moe. He then founded his own building business and became a prosperous businessman. The building business was eventually taken over by Magnus's son, Robert.
Magnus met the Governor of Victoria, Lord Linlithgow the Earl of Hopetoun. The earl mentioned that he had known Magnus's father as a very honest man.

According to "The Aitken's of Mosgiel": "James was born (on the 7 Sep 1856,) at East Taieri and educated at the local school. Working on his father's property he heard that land was available for settlement from the 'Knapdale run', he managed to secure section 13 of the Chatton survey district block 1. His two brothers, William and Peter, bought adjoining sections, 11 and 15. It took them three days from Kahiku to the Waikaka Valley where they found their land was covered with red tussock. He called his property Hawthorn Den. Breaking in the land immediately they sowed their first wheat crop. When harvested they carted the wheat to Tapanui where they waited whilst some of the wheat was ground into flour and taken back home. James was a very tidy farmer and a first class agricultururalist and stockman."

After Helen and James were married they travelled to Gore by train and then by dray to James's block.
James and Helen were prominent in their local Presbyterian Church, where James was the choir leader. James possessed a fine tenor voice and family and friends were encouraged to gather round the piano or tuning fork, which James preferred.
James purchased his brother William's property in 1882, when William went to farm at Longbush.
When James died his son William (Bill) took over the property.

About 1855, with a downturn in his father's fortunes, the family had to move from Silvermine Farm to Montaree Farm. This was around the other side of the Cairnpepple hill. Every person in the family had to help with the removal by carrying furniture, goods and belongings. Young John had to carry his own chair.

When the family arrived at their new home, John was missing. A search was instituted. The elder children were sent to retrace their steps. John was eventually found fast asleep on his chair on the side of Cairnpepple hill. He had stopped for a rest, sat down on his chair and fallen asleep

Quite enjoying his drink there was many an occasion when Johns horse would bring him home whilst he was asleep lying in the back of the cart. This whilst working for Melrose Drovers.
Later on John had a gardening contracting business and he used to keep his tools under a pub in Goldenacre. Thus it was handy for his afterwork ale.

After his wife died he used to visit his son, Tom and family, at Craigmiller. Sinclairina Stewart (nee Aitken), remembers him as a small man, looking very much like Beaverbrook. Sinclairina remembers that whoever met him off the bus would always receive a silver threepenny. As a present, to the house, he would also have a packet of Abernethy biscuits and a bag of pan drops.

Most of the information I have on Peter is from a write up in the local newspaper after his death. He did most of his training, as a gardener, at Wallhouse and held posts at Tyninghame Gardens, the home of the Earl of Haddington, and other posts.

He set up his own business, as a nursery gardener, at Morningside, Edinburgh in about 1887. Aproximately 10 years later he moved to Ballencrief nursery where he continued until his death.
He was famous for his growing of Alpines. It was said that "Amongst his Alpines, Peter was at home. He handled them and looked on them as a lover looks on the charms of his mistress." He won many medals at all the big shows. The Kirkton Public Bowling Greens, Bathgate, were laid out by him. Regularly asked to be a judge at local shows. Peter was a very quiet and modest man.

James Aitken Smith, in 2006, remembers his house at Ballencrief Nursery and described it thus; "The house at Ballencrieff Nursery looks , from the gate, back to front as the back of the house is facing you. The original intention had been to have the entrance on the hill road, where the gate of 'Sunniside' now is. Instead the present entrance on the Gateshields road was opened. The house had a scullery , large kitchen with 2 built-in beds, 2 bedrooms and large lounge, 'The big room'. Half of the loft was an attic which was where the boys slept. The rest was open space. The toilet was a dry closet and water came from a spring on the hill above, to an outside tap, which had branches to the greenhouse and washouse. Cooking was on a range in the kitchen. It had the usual oven on one side of the fire, but on the other was a boiler which had to be filled with pails carried from the outside. At least it had a tap which meant there was a supply of hot water for face, hand and dish washing. Baths were had in the washouse. Lighting was by oil lampalthough for as long as I knew the house it was the more advanced Tilley lamp which has a mantle and uses paraffin vapourised under pressure.
He grew many different plants. The one most associated with his name was the Gentian, especially Gentian Acaulis, the spring flowering blue trumpet variety.
In a catalogue he was advertising small Gentian Acaulis at 9d in 3" pots. However the rarer Acualis Alba was 7/6d. This would equate to about 30 pounds at todays prices.
Peter showed his wares at not only local shows like Linlithgow, and Falkirk, but also nationally at Waverly Market, Edinburgh, and Kelvin Hall, Glasgow.

The story is told, within the family, that "Unc" a notorious black sheep of the family, had his own still, distilling illegal whisky, which he would load onto his buttermilk cart and take to Edinburgh to sell. At one time he found out the Customs men were on his trail. He disposed of the still by throwing it into one of the limestone quarry ponds. It was found by the Customs but they could not prove it belonged to "Unc".

"Unc" became a tramp and at one time James Lind Aitken and Ann Eliza Aitken found him asleep in their barn. He was in such a mess that Ann took all his clothes and burnt them. After he was given a bath and new clothes he disappeared again

Robert Carlyle married Jessie Stewart, no children of marriage. They lived on 3 acres of property adjoining the Stewart farm [at Silverstream, Taieri]. Robert died young (consumption TB?) and Jessie lived in a 2 room place after he died. She made ice cream and home made sweets [for sale]. In 1918 she was the midwife at Jessie Carlyle AITKEN's birth. Jessie remembers as a young girl crossing the stream to visit her, which she did quite often. Jessie looked after Mrs Carlyle when she became ill, which could have been after 1947, as she remembers she [Jessie AITKEN] had her two children then. Mrs Stevenson remembers a beautiful ring Jessie had, a wide gold band embossed which opened out to show the words 'Ever Thine'. Jessie AITKEN was named after this Jessie Carlyle, but also her father's sister was named Jessie.
